Civil Division

Under New Hampshire Revised Statutes Annotated 104:5, the Sheriff of Belknap County or his deputies are required to serve and execute all writs and other process, having been directed to him, issuing from lawful authority.

Please complete the :Civil Document Intake Sheet  This form should be as complete as possible and brought in with the paperwork to be served.

$ 1.00 is added to each document for Postage & Handling.

Travel is charged at the rate of .54 cents per mile round trip for each attempt and this is in addition to the above listed service fee.

In hand service by court order or court rule is additional $25.00.

Additional costs added to the above include $1.00 the first page and $0.25 each additional page for copies, $15.00 per hour for search time, waiting time, conducting an inventory and/or sale.

You will also be charged for recording and filing fees where applicable, and publication costs

Prepayment is required and it is advised that you call ahead for the amount to send. Checks and Money Orders are to be made payable to Belknap County Sheriff’s Department.  Electronic payments are accepted for credit or debit cards, a fee of 4% will be assessed.  Electronic payments are only accepted in person.

The Civil Department is open from 8:00 A.M. to 4:00 P.M., and accepts telephone calls from 8:00 A.M. to 1:00 P.M. Monday through Friday.

Personnel at the Sheriff’s Office are not allowed to dispense legal advice. You are responsible for having your documents completely and accurately filled out before presenting them for service. Should you have questions regarding legal process, you should contact an attorney or call the Legal Advice and Referral Center at 603-224-3333 or 1-800-639-5290.

Please be aware that the courts set specific time frames within which most documents must be served. Failure to present all of the copies in a timely fashion may preclude service.

Additionally, please review your documents when you receive them from the Court to be sure they are accurate before bringing or mailing them to the Sheriff’s Office.

When you present your documents for service, please be sure to provide your mailing address and a telephone number where you can be reached.
